Walnut, CA owners getting evicted from condo


Question:

My sister and I co-own a condo and fell short on our mortgage and association in 2010 due to layoffs and undue hardships. We tried to refinance and made several attempts to reconcile with the HOA. We made arrangements with the HOA to catch up and were able to for a while. Unfortunately we fell behind again. In the meantime our mortgage was also falling behind. We tried to get a modification approved but that didn't happen until after I filed bankruptcy in 2011. In the meantime the HOA got an attorney and added additional fees to our balance which now made it even harder for us to catch up. Still unemployed and on UI benefit we again tried to make arrangements with the attorneys. We made a few payments but got behind again. They refused any further payments from us and mailed back the check. Since we have been in arrears with them. The balance is now over $23, 000. They have filed a lien on our property and recently found out that they exercised that lien by taking Title of our condo. While all this is going on, in 2012, we decided to try to just sell the property and get out. We found out that was not so easy. in 2013 we began a short sale with the bank. They approved but kept denying all offers because they felt the property was worth more than the appraisers & inspectors were appraising at. It has been a long nightmare and emotional hardship on both my sister and me. At this point we have another short sale pending, but now the HOA has hired another attorney to evict me and now suing me. We have communicated with them that the outstanding balance has been factored into the sale and they would be paid. But they are filing charges of hardship and asking me to pay them rent of $60 per day. I have paid for some legal advice but no attorney. What should I do?.  Walnut CA.
